An illegal alien involved in a recent vehicle accident near Tunnel Hill is employed by the city of Calhoun, City Administrator Eddie Peterson confirmed Wednesday. The city hired Jose Jorge Patino-Monroy in 2000 as a maintenance worker at Fields Ferry Golf Club, Peterson said in a written release.

Larry Stewart, 61, of Rocky Face was driving a motorcycle and suffered a broken femur and two crushed ankles when Patino-Monroy pulled in front him in a 2003 Chevrolet S-10 pickup on Highway 41 in Tunnel Hill, officials said. Stewart’s granddaughter who was riding on back, Baylee Martin, 7, sustained abrasions and cuts on one leg that required stitches.

Patino-Monroy, 26, of 3720 Water Tower Lane in Tunnel Hill, was denied bond by Judge William Boyett in Whitfield County Superior Court on Tuesday. He is charged by the Georgia State Patrol with leaving the scene of an accident, driving without a valid license, failure to yield right of way after stopping at a stop sign, failure to report an accident with injuries, driving on the wrong side of the road and causing serious injury by vehicle. He is on an Immigration and Customs Enforcement (ICE) hold at the county jail, a spokeswoman said.

Public Defender Brandon Sparks asked Boyett to consider an $8,000 bond.

“Mr. Patino-Monroy has lived in the Dalton area the last seven years,” he said. “If he is able to make bond, he will be living at a Tunnel Hill address. He is married with a 2-year-old son who is ill with a heart condition. This is his first arrest, and he is currently employed as a landscaper.”

When Boyett asked Sparks who the landscaper is, and the question was translated to Patino-Monroy, Sparks replied that the employer is the city of Calhoun for the last 10 years.

“At that time, he presented the required documentation as proof of his U.S. status,” Peterson stated in the release. “Calhoun received a Resident Alien Card issued by the U.S. Dept. of Justice and we were presented with a Social Security card in Mr. Patino’s name.”

At that time, the city did not use the internet-based E-verify system that is in place now and allows employers to check a potential hire’s eligibility to work legally.

Monroy has worked continuously for the city for 10 years, so the city has not had cause to run a records check on him since he was hired, Peterson stated.

He said the city has caught people working illegally in the past and has had to terminate their employment.

Processes are already in motion involving this situation and the city’s personnel policy, he said, which states that if Monroy’s information is fraudulent, he will be let go.

“If other valid information is presented to us, we’ll address that also,” Peterson.

An attorney representing the family affected by the wreck said on Tuesday that Patino-Monroy “needs to have to answer” to the charges against him before he is possibly deported.

“We will file a civil suit, for sure,” attorney Sam Sanders said outside court. “Mr. Stewart is hurt really badly, but thank goodness he’s alive. Both of his legs are injured, almost beyond repair. And it’s my understanding that the abrasions his granddaughter sustained are scraped skin all the way to the bone.”

Stewart, who was airlifted to Erlanger Hospital in Chattanooga, is expected to face skin graft surgery today.

Assistant District Attorney Susan Franklin said her office is opposed to bond, citing the immigration hold.

“We may lose (Patino-Monroy) if he is given bond,” she said of the potential for jumping bond.

Boyett asked Franklin if one of the charges was a felony, and she replied yes (causing serious injury by vehicle).

“I am denying bond because he is a threat not to appear,” Boyett concluded.

“We are opposed to him leaving the country until those (charges) are dealt with, criminally and civilly,” Sanders said. “Whether he gets bond or not, he needs to have to answer for (causing the wreck).”

My grandson has been loooking for a job for two years in calohun. Now its that the city hires cheap labor?? The city is not the only place that hires them either. But if they would read the federal law about aiding and abeding, tyhey should be held accountable. Are we going to put up with this. Been in calhoun 30 years, and am ashamed. I know od two maby three more places that hire these illigals also. Thier not hard to find. If they walk like ducks, quack like ducks, there usually ducks. They need to go, Americans need jobs.

LOL!!! You people better quit profiling this good citizen, he has more rights than you do!!!

I'm sure glad to see people finally opening their eyes. The good old US of A is headed down the tube>>>

I am a white American. Lived in Georgia all my life. When I went to work for Gordon County 18 years ago, every thing about my life was checked. Work history, finger prints, even mothers maiden name.So I hope the man and grand daughter that this illegal hurt SUES the city of Calhoun. Then maybe they will stop hiring them. Also seems like some people on here are worried about this illegals child with a heart condition.DO NOT worry, Im sure this kid gets great health care just like all of them do. Better than us with insurance.

It is also possible the marriage between him and his wife (assuming she is a U.S citizen)is invalid if he used a fake or stolen SS card or documents to obtain marriage license.

~ "good guy or not" this guy committed several crimes. Those of us commenting here aren't judging this guy, we're questioning the actions of this guy, and the City's hiring policy; while all along wishing a speedy recovery for the two injured.

You dont have to be "rich" to become a citizen, you just have to have the DESIRE...sure it isn't easy, or expediant, but this guy had ten years...ample time to apply.

Also, our armed forces are comprised of thousand of non-citizens solders...after the completion of 24 months of service, you file for citizenship, study, take the written test, in "in your native language" and become a citizen...maybe you too should look at both sides or the fence especially where you plan to jump so that you don't step in a pile of (%$@#) that clouds your own "judgment".

redmexspeaks, The fact he has a child with a heart condition, married to one of "ours", and a "good guy" or not, does not change the fact he is here illegally, and has broken several laws in that accident. Not to mention presenting false paperwork in order to be hired. ALL of that is illegal. When you break the law, there are consequences.

As far as I know it is not illegal for a minor child to ride a motorbike, as long as she had a helmet, etc.

Ok here we go again...hey cranky and other cold hearted people out there...

1. He is married to one of yours...lol

2. Read the article again he has a 2 yr old out there with a bad heart condition....

3. He did not leave the scene....

4. Why was there a 7 yr old on the back of the motorcycle....always have to look at both sides of the fence not just your side...

5. To get papers you have to be rich...to be rich you have to have money...to have money you have to have a job...to have a job you have to have papers...answer that one....

if you read the article it clarifies that the procedures to identify illegals were not available 10 years ago. i'm sure they now do a more thorough check.

This guy used a fraudulent SSN to get the job and the city didn't even care. The is the exact illegal alien the DOJ lawsuit against AZ has no problems with. Because he had no criminal record until now (?) they don't care if he's here illegally. Now that two people are almost killed will they be forced to do something.

So the insane policies of the feds is wait until someone is harmed or killed first, then they DO THEIR JOB. Lets send 400,000 illegals to live in Washington DC and the areas where the politicians and lawyers live!

If anything can better this it's not easy. Pay taxes, pay medical bills, pay medicine, put single families in houses, buy your own groceries, pay your insurance.......... Do this and we'll get out of the hole and America will start getting back on track. Then the other countries will be affected as we are. There won't be money to send home. Oh and A United States birth certificate should be required for goverment benefits. If you or your family has never worked or lived here why should you get what Americans pay in to?

sonnyvw, I think you need to read the article again......Apparently you failed to see that The City of Calhoun said they were presented with a Social Security card with Mr. Patino's name on it. Would you assume that this means that they had a number to file his W-2's with? I am sure that the City of Calhoun made a good faith effort to cover all aspects of hiring this individual legally. I do agree that we are all taxed to death and all should pay their fair share legal or not, but face it, most are a little guilty of trying to evade the system at times legal or not when it comes to the IRS. Perhaps this makes us being legal citizens whom are trying to beat the system. So in short, we should all clean out behind our own front or back doors before we start harping about what someone else may be doing. Kudo's City of Calhoun, I do believe you have made that good faith effort. Also, a little computer etiquette, WRITING IN ALL CAPS COMES ACROSS AS SCREAMING! Hope your day is just as nice.

The Facts

What if he was employed by one of the Big 3 in town? Would we be asking the same questions of their hiring practices? Probably not, because the majority of the computers that submit these comments were purchased with money made from those employers, or the family has members who work for the corporations.

The City of Calhoun doesn't have the budget of the big employers; they do a great job with what little resources they have.

However, as we all know, it takes something like this to shake the status-quo...we can only hope that Mr. Petterson will do what it takes to eradicate ALL employees that do not meet the "current" requirements, regardless of their hiring date. It's called ~ accountability
