Gordon County man files suit over treatment in jail

A Gordon County man is suing the county, former Sheriff Jerry Davis and jail medical personnel, alleging inadequate medical treatment at the old Gordon County Jail left him permanently disabled.

Barry Benson and his wife Kellie Benson seeking payment for medical bills Barry Benson incurred after he was transferred from the jail and unspecified punitive and compensatory damages, according to a suit filed earlier this week in federal district court in Rome.

In the suit, Benson alleges that indifference to his medical needs while he was in jail in July and August 2008 led to serious and permanent injuries that left him confined to a wheelchair.

County Attorney Suzanne Hutchinson said Thursday that she has not seen the suit and could not comment on its allegations.

According to the suit:

Benson turned himself into jail officials in July 2008 for a number of outstanding warrants.

At the time, he notified jail officials that he was diabetic and had recently suffered severe back injuries in a motorcycle accident in July 2008.

He claims jail officials denied him adequate medical treatment and as a result he suffered permanent injuries that have left him without the use of his legs.

Just because one has broken the law , does not mean they don't get sick or have ongoing medical issues... I am aware of others that have been ignored the medical treatment in which they need, which too would be considered life threatening, let this lawsuit be a lesson well deserved for Gordon County, Georgia

The ONLY thing that the DA does in this county is pave the way for his son-in-law, and other relatives to have jobs! Victims of domestic violence lost a battered women's shelter here, with no accounting to state officials, when its embezzling and check-frauding, executive director, Michele Pierce, used local, state and federal funds for her own personal expenditures. This was all settled very quietly, with very little publicity. The State of Georgia stepped in and mandated that Gordon County could NEVER have a battered women's shelter here again as it's BOARD OF DIRECTORS had woefully neglected their duties and fiduciary responsibilities - and, yet, the DA DID NOTHING. In addition to this the 7.5% surcharge, state allocated for service to victims of domestic violence, GOES TO WHITFIELD COUNTY - again because of a lazy BOD, and ineffective District Attorney. CORRUPTION is the order of the day in his office.

GREAT! FINALLY, someone has the spunk to sue over violation of civil rights in Gordon County/Calhoun, GA. Appropriate/Malicious or not, this kind of suit is LONG overdue, in a county where the "Good ol' boy" system takes precedent over justice, moral and civil rights. Win, lose or draw, Mr. Benson, THANK YOU for letting this county, its laurel-resting attorney and city/county government realze that they are not just a part of the "beautiful and privileged 400," but that it's the REST of the citizens that make their lives so comfortfortable - even if undeservedly so! WAY TO GO!
