ATLANTA (AP) — Prosecutors say five racketeering counts once faced by a Georgia sheriff should be reinstated.
Clayton County Sheriff Victor Hill still faces 32 felony charges stemming from his first term as the county sheriff from 2005 to 2008.
The Atlanta Journal-Constitution reports (http://bit.ly/Xz4f0J) that prosecutors on Tuesday argued before an appeals court that the five charges should be reinstated because they say the campaign funds were not Hill's personal assets.
Hill's attorney said a lower court judge was right to dismiss the charges.
Special prosecutor Layla Zon said she wants the appeals court to weigh in because she said it ultimately could set a precedent for what candidates can do with campaign money.
Despite the charges facing Hill, voters re-elected him last year and he was sworn into office Jan. 3.
